Morning Docket

Morning Docket: 10.03.17

* The Supreme Court declined to hear a case about vending machines and the ADA. This isn't such a big deal right now, but with tech gurus trying to turn America into a vending machine hellscape, this was a good opportunity for the Court to get out ahead of the curve. But we all knew that wasn't going to happen. [Law.com] * I think this is supposed to sound heroic, but the story of lawyers in Fort Lauderdale racing against Hurricane Irma to close a deal just seems like a cautionary tale about becoming a lawyer. But, you know, good for them for getting it done. [Daily Business Review] * Trio of top-flight prosecutors leave the SDNY to form Krieger Kim & Lewin LLP. That's 30 years of combined talent walking out of the SDNY all at once. And some impressive stories. Plots to assassinate ambassadors? The bin Laden case? A bevy of corrupt state officials? Hey guys, things might be a little less exciting for a couple months. [NY Times] * Meanwhile, the former EDNY U.S. Attorney, Robert Capers, joins Arent Fox. [Wall Street Journal] * Novel takes on a fantastic premise: a likable Biglaw protagonist. [Amazon (affiliate link)] * A group of lawyers are driving an anti-gay agenda? What firm did they crawl out from? Oh... right. Obviously. [The Careerist] * If you didn't catch it over the weekend, WNYC's More Perfect is back taking a deeper dive into Supreme Court. Check out Elie Mystal interviewing Judge Posner in this episode on Korematsu. Wow, Judge Posner is astoundingly nihilistic about courts. [More Perfect]

* The ABA announced its Silver Gavel winners and the Supreme Court podcast More Perfect won for radio. (Ed. note: I HELPED!) [ABA Journal] * Speaking of things I help with, the latest Radiolab is all about jury nullification. There's also a guy that literally calls for violence, and it's not me. [Radiolab] * In non-Comey news, Donald Trump is still president. [Mother Jones] * There are all sorts of problems with Mike Pence's voter fraud commission, but here are four of the best ones. [Election Updates] * The rare cabbie kidnapping case that doesn't end tragically. [Gothamist] * To be clear, I would have NO PROBLEM with Trump canceling press briefings. I see NO VALUE to Sean Spicer lying to the public while the White House press corps guffaws and plays along. There is no information being conveyed, the press are being used as a tool to spread misinformation. [New York Times] * Time for our weekly check-in with what's going on over on the Alt-Right. Are they annoyed with Sessions, now that he seeks to take away the liberty of non-violent drug users? Well, the headline is: "Bad Hombre Crackdown: Sessions Ramps War on Drug Traffickers" so... as long as only brown drug abusers are arrested, I think they're good. [Breitbart]

* A look back on this noteworthy Supreme Court term. Conservatives started the term with such high hopes, but those were dashed after the death of Justice Scalia. [Jost on Justice] * More Perfect, a podcast bringing the stories behind the highest court in the land to life. [RadioLab] * Review of the new book (affiliate link) that posits the Supreme Court's move to the right began with the Berger Court. [Washington Independent] * Yay! You can sing "happy birthday" in public! Thank you plaintiffs' bar! [TMZ] * Remember lawyers, clients are there for you to take care of, not the other way around. [Katz Justice] * Got a parking ticket? Maybe this robot lawyer can take care of it for you. [The Mirror] * An excellent source for in-house lawyers, and yes, it's free. Unless You Ask: A Guide For Law Departments to Get More From External Relationships [Association of Corporate Counsel]
